WHAT IS A QUALIFIED DOMESTIC RELATIONS ORDER (“QDRO”)
A QDRO is a legal order entered as part of a divorce or legal separation that splits and changes ownership of retirement plan to give divorce spouses their share of the assets or pension plan. If you divorce settlement agreement states that you will divide a pension and/or 401(k) plan, a Court must order a Qualified Domestic Relations Order commonly abbreviated as a QDRO.
A Qualified Domestic Relations Order is a domestic relations order which creates or recognizes the existence of an “alternate payees” right to receive, or assigns to an alternate payee the right to receive, all or a portion of a portion of benefits payable with respect to a participant under a Retirement Plan.
