MORTGAGE PAYMENTS

Pursuant to Pa. R.C.P. 1910.16-6(e), mortgage payments are “additional expenses” that may be allocated between the parties in a support matter.  The support guidelines presume that the spouse occupying the marital residence will be solely responsible for the mortgage payment, real estate taxes, and homeowners’ insurance.  Where only one of the parties continues to reside in the marital residence post separation and the mortgage payment exceeds twenty five percent (25%) of the monthly net income of the residing party, the court may increase the support obligation if the residing party is receiving support or decrease the support obligation if the residing party is paying support.
